General Terms and Conditions of Sale
General Terms and Conditions of Sale (hereinafter referred to as "GTC")
The General Terms and Conditions of Sale (GTC) constitute a legal agreement and apply to all service and product orders concluded between the Client and the Photographer. Any booking of a session or product order implies full acceptance of these GTC, except for specific conditions agreed upon in writing between the Photographer and the Client.

Definitions
Under the present General Terms and Conditions of Sale, the following terms have the meanings specified below:
The Photographer:
Cyril Millin, a photographer registered under the specified SIRET number at the address mentioned.The Client:
Any entity, whether an individual or a legal person, who places or has placed an order with the Photographer.Order:
Any service or product request made by the Client to the Photographer.Product:
Any product sold by the Photographer, derived from the photography session or photographic reportage, including photographic prints, digital files, albums, books, etc.Package:
Any package chosen by the Client at the time of the order, which includes, in addition to the photography session, certain derivative products from the session or photographic reportage.Website:

1. Prices
Prices are expressed in euros and are tax-free (VAT not applicable under Article 293B of the French General Tax Code). The applicable prices are those in effect at the time of booking a session or ordering additional products. Prices are subject to change at any time without prior notice. However, changes will not affect ongoing contracts and previously issued offers.
2. Booking / Payment
Session Booking:
Bookings can be made via phone at +33 7 69 89 77 32, private message on the Facebook page, or email at contact@1001fotos.eu. The booking defines the date and time of the session.Deposit Requirement:
A deposit of 25% of the quoted price is required at the time of booking. Photos will only be delivered after the total payment has been received.
The booking is considered final only upon receipt of the signed quote marked "Approved," along with a deposit check amounting to 30% of the quoted price. In case of cancellation by the Client, the deposit will not be refunded. The session date will only be confirmed after receipt of the deposit.
Payment Deadlines:
If payment is not received within 5 days of the Photographer's agreement to the date and time with the Client, the booking will be canceled without prior notice, and no compensation will be granted to the Client.Accepted Payment Methods:
Payments can be made via check (payable to 1001Fotos), bank transfer, or cash. The total payment for additional products must be made in full on the day of the order.
According to Article 121-20-2 of the Consumer Code, the right of withdrawal does not apply to personalized products.
For bounced checks, the Client will be notified and must pay the balance in cash within 72 hours. Any delay in payment will incur interest at the rate stipulated by Article L-441-6 of the French Commercial Code (legal interest rate multiplied by 3), along with a fixed penalty of €40.
Session Timing:
It is essential to arrive on time for the session. Late arrivals will result in a shortened session to avoid disrupting subsequent appointments.
3. Travel Expenses
The Client is responsible for the Photographer's transportation and accommodation costs.
By the Photographer's Vehicle:
A mileage allowance of €0.69/km will be charged for the round trip between the Photographer's residence and the session location.By Public Transport (Bus, Train, Plane):
The cost of round-trip tickets will be borne by the Client.
4. Gift Vouchers
Gift vouchers can be requested and must be paid for in full at the time of purchase. They will include a receipt specifying the recipient's name, surname, and the type of session chosen.
Conditions:
Gift vouchers are valid for a limited time, are non-transferable, and the recipient cannot be changed. Once the validity period has expired, the voucher is non-refundable, and the session is forfeited.
To ensure proper planning, the recipient must book their session at least TWO (2) months before the gift voucher's expiration date.
5- Conduct of a Session:
The client agrees to arrive on time for the scheduled session. If you arrive late, your session will be shortened accordingly. If the delay exceeds 30 minutes, the session will be canceled, and the client will forfeit any amounts already paid without the right to a refund, credit, or rescheduling.
The client agrees to facilitate the photographer’s work during the session. The photographer cannot be held responsible for lower-quality photos due to a lack of cooperation from any of the participants.
All types of cameras or recording devices (including mobile phones) are strictly prohibited during the sessions. Failure to comply with this rule grants the photographer the right to terminate the session and delete all photos taken.
With prior agreement from the photographer, one or two “backstage” photos (wide shots of the overall session) may be authorized.
Only individuals participating in the photo session are allowed to be present during the shoot.
You may bring personal outfits and accessories, but their use is at the discretion of the photographer, depending on how the session unfolds.
6- Delivery of Photos
At the end of the session, the images are made available online in a private gallery. The client receives an email with a link to the gallery and a unique password for access. The client may share these access details with their circle to share the images but assumes full responsibility for this sharing. The photographer is not liable for any misuse of the images by individuals with whom the client shared their access details.
The client must select the photos they wish to receive in digital format or as prints from the gallery, in accordance with the details of the validated quote. The client agrees to provide the list of chosen photos in writing to the photographer. For packages that include albums, the client must specify their preferences for which photos to include in the album(s).
Final digital files are provided in JPEG format. Each photo comes with two digital files: one in high resolution (for later printing) and one in low resolution (for online sharing).
7- Delivery Methods
Products can be delivered to the client in person, by mail, or electronically if they are digital (e.g., downloadable files or electronic gift cards).
In-person delivery is only possible by appointment and if the meeting location is within 30 km of the photographer’s residence. If in-person delivery is desired, this must be communicated to the photographer at the time of product ordering (for additional products) or when submitting the list of chosen photos (for products included in the package).
It is the client’s responsibility to properly preserve the digital files provided by the photographer. The photographer is not responsible for any loss or deterioration of the digital files or physical documents provided to the client. Any request for duplicates will be subject to additional charges.
8- Technical Issues
In the event of a technical problem with the photographic equipment or an unforeseen accident during the session that prevents the photographer from completing the agreed work, the full amount paid will be refunded, without any compensation or damages of any kind. Alternatively, the client may agree to reschedule the session to a later date, in which case the amount paid will not be refunded.
Despite all due care taken with the digital files, there may be rare instances where the photos become unusable due to accidental handling, unintentional destruction, defective memory cards, or system failure. In such cases, 1001Fotos offers the client the option to redo the session to make up for the incident beyond its control. Should the client decline, they will only be entitled to a refund of the amounts paid, with no additional compensation.
9- Photographic Style
The client acknowledges being familiar with the photographer’s photographic style and requests their services with full knowledge of the artistic approach.
Post-processing, like shooting, is unique to the photographer and is an integral part of their work, style, and artistic vision. The photographer alone determines the post-processing applied to the digital negatives. Only the photos processed by the photographer can be used by both parties. The client accepts that this vision may differ from their own. No photo can be rejected based on the client’s personal tastes or preferences. The selection of images is at the discretion of 1001Fotos, and there is no guarantee that any particular image captured during the session or specifically requested by the client will be included in the gallery. The photographer reserves the right to refuse to create images that do not align with their photographic style.
No raw files will be delivered to the client, nor can they be requested. Digital files are delivered in the highest-quality JPEG format.
Photos will be stored on the dedicated website for three months (unless affected by unforeseen disasters such as a defective external drive, flooding, fire, etc.). After this period, the photos will be deleted from the website.
Prints made outside a professional lab may vary in color and quality, and the photographer is not responsible for issues that may arise in such cases.
Basic retouching (cropping, removal of scratches, animal leashes) is included in post-processing. Advanced edits (AI incorporation, background modification, addition of elements) are subject to an additional charge of €70 per requested photo.
The client will be notified by email or SMS when their gallery is online (typically within 1 to 4 weeks). The photographer places print orders with the lab on the last day of each month. Prints, albums, calendars, and other products ordered by the client will be mailed to the specified address, depending on the photographer’s schedule. The photographer carries insurance to cover loss or damage during shipping, and a replacement shipment will be arranged if necessary. Delivery times are provided as estimates; the photographer cannot be held responsible for delays caused by suppliers or for damaged goods upon delivery, and no compensation can be claimed in such cases.
10- Force Majeure and Illness
The photographer reserves the right to cancel a photography session due to force majeure or illness. Such cancellations do not hold the photographer liable or entitle the client to any compensation.
The photographer agrees to reschedule the session. Force majeure includes unforeseeable external events that make it impossible to perform the service (e.g., accident, death, snowstorm, storm, ice, illness). Either party may invoke this right when force majeure is evident.
The photographer or client must notify the other party as soon as possible by phone at 07 69 89 77 32. A new date will be mutually agreed upon at no additional cost for the same service.
Any request for changes (date, time, location) by the client must be made at least 15 days before the scheduled session date, except in cases of force majeure. However, the rescheduled session must occur within 30 days of the original date, subject to the photographer’s availability. In case of rescheduling, the photographer cannot be held responsible for missed session-specific elements (season, weather, shooting location).
If the client cancels the session, the deposit will not be refunded, as it covers preparation costs and the loss of a photography session. French law requires that the balance be paid to the photographer.
11- Intellectual Property
In accordance with the March 11, 1957 French copyright law, the photographer retains the rights to all images captured during a session and reserves the right to reproduce them for promotional use.
Even after transferring digital files, the photographs remain the intellectual property of the photographer and are not royalty-free. The client’s image rights, however, remain inalienable. Commercial use of the photographs is prohibited without the photographer’s written consent.
Any unauthorized use of a photograph (e.g., contests, distribution, exhibitions, reproduction) constitutes copyright infringement under Article L-335-2 of the French Intellectual Property Code. Penalties include up to 3 years of imprisonment and fines of up to €300,000.
It is illegal to digitize prints for online publication, remove the photographer’s logo/signature by any means, or modify photos (e.g., converting to black and white, applying filters, cropping, retouching).
For any public use (including social media), the client must credit the photographer.
If the client denies publication rights to the photographer, they are also prohibited from publishing the photos (e.g., on Facebook, Instagram, Twitter). If the client publishes them, the photographer reserves the right to publish the images as well, even if the contract states otherwise.
12- Image Rights & Publication
The photographer commits to signing a “reproduction and representation authorization” agreement with the client, allowing the photographer to use the photos for promotional purposes (e.g., on Facebook, their website, Instagram, trade shows, portfolios, brochures). The client is free to decline the use of their image. However, if they do so, they are also prohibited from sharing their photos in any form, respecting the photographer’s copyright.
If the session was offered or discounted by the photographer for promotional purposes, and the client ultimately opposes the photos’ publication, they must pay the full session fee plus a 50% penalty.
The photographer respects clients' privacy. All collected data is solely for the photographer’s use and will not be sold or shared with third parties.
13- Civil Liability
The client is responsible for themselves, any minors, and any animals accompanying them during the session.
The photographer is not liable for accidents or equipment damage that could have been avoided during the session. No legal action can be taken against the photographer.
If the client or their children damage the equipment, they must reimburse its full replacement cost. If the accident is the photographer’s fault, their professional liability insurance will cover the damages.
The photographer reserves the right to modify these terms and conditions at any time. Changes take immediate effect and apply even to prior bookings.
14- Applicable Law
All services provided by the photographer are subject to French law. Before taking legal action, both parties agree to submit any disputes to a mediator designated by professional photographer organizations.
Any disputes related to these terms or the photographer’s services will be referred to the Saint-Brieuc Commercial Court for resolution.
The client acknowledges having read and accepted these terms without reservation.

How are your data collected?
Through messages, calls, quotes, and invoices. These data can be erased upon request.
Who is responsible for and has access to this data?
Only the photographer.
Why are these data needed, and for how long?
French law requires invoices to include client details. Email addresses, physical addresses, and phone numbers are retained unless the client requests their deletion. Requests for data deletion can be made via email at contact@1001fotos.eu.
According to Article L123-22 of the French Commercial Code, invoices must be retained for 10 years after the fiscal year ends. Article 1734 of the French General Tax Code states that failing to maintain or destroying such documents before the required time can result in fines of €5,000.
The photographer uses this data solely to meet legal obligations (e.g., invoicing, order fulfillment) and to communicate with clients about their orders. There will be no data sharing, prospecting, or dissemination.
